Terms of Service

Effective August 10, 2026. NerdFax is a product of Habibi Asset Management LLC (“NerdFax,” “we,” “us”).

1. Who this applies to

These Terms govern use of NerdFax's fax-sending service, available both without an account (anonymous, one-time sends) and with a NerdFax account. By using the service, you agree to these Terms.

2. What NerdFax does

NerdFax transmits documents by fax on your behalf to a fax number you provide, and provides a record of that transmission (a “trace”). NerdFax does not review, endorse, or take responsibility for the content of documents you send.

3. Your responsibilities

• You must have the right to send the document and to send it to the recipient fax number you provide.
• You are solely responsible for the accuracy of the recipient fax number and the content of the document.
• You will not use NerdFax to send unsolicited faxes, or faxes to any number without the appropriate consent or established business relationship required by applicable law (including the U.S. Telephone Consumer Protection Act and its implementing regulations). NerdFax does not provide bulk, list-based, or broadcast fax sending, and using the service to attempt this is prohibited.
• You will not use NerdFax for any unlawful purpose.

4. Pricing and payment

Fees are disclosed before you pay. For a one-time fax, your card is authorized but only charged after NerdFax's records show the fax was successfully delivered; if delivery is not confirmed, the authorization is released rather than charged. Accepted payment methods are limited to card, Apple Pay, and Google Pay. NerdFax does not currently offer refunds for successfully delivered faxes, since payment is only ever taken after confirmed delivery in the first place; if you believe you were charged in error, contact us (Section 10) and we will look into it. Subscription-plan terms will be published separately once those plans are generally available.

5. Accounts

Creating an account is optional. If you create one, you are responsible for maintaining the security of your login and for all activity under your account. A one-time fax sent without an account can later be claimed by an account you create or sign into, as described in the product itself.

6. Service availability

NerdFax relies on third-party telecommunications and payment providers to deliver its service and does not guarantee uninterrupted availability. NerdFax does not currently offer a service-level agreement (SLA).

7. Disclaimers and limitation of liability

NerdFax is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Fax transmission depends on third-party telephone networks and equipment outside NerdFax's control, and NerdFax does not guarantee that any fax will be deliverable at all times. To the maximum extent permitted by law, NerdFax's total liability for any claim arising from your use of the service is limited to the amount you paid NerdFax for the fax giving rise to the claim.

See NerdFax's separate Health Data & HIPAA Disclosure page for how NerdFax currently handles — and does not yet handle — health-related documents. In short: NerdFax's current release is a general-purpose consumer beta, not a HIPAA-covered product, and does not have a signed Business Associate Agreement in place.

9. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the effective date above. Continued use of NerdFax after a change takes effect means you accept the updated Terms.
